Additional rules that apply when you use Hustl.it to run a business — accept payments, manage clients, or operate commercially.

BUSINESS USE POLICY

Hustlit Operated by Mosco Holdings LLC

1. APPLICABILITY

This Business Use Policy ("Policy") applies to users who use Hustlit to conduct business operations, accept customer payments, provide services, or engage in any commercial activity (collectively, "Business Users" or "you").

If you use Hustlit for personal, non-commercial purposes, the standard Terms of Service apply. If you are a Business User, you agree to both the Terms of Service and this Business Use Policy. In case of conflict, this Policy takes precedence for business use.


2. BUSINESS ACCOUNT REQUIREMENTS

2.1 Eligibility

To establish a Business Account, you must:

  • Be at least 18 years of age (no exceptions for minors)
  • Provide accurate business information and ownership details
  • Complete full KYC verification and identity confirmation
  • Comply with all local, state, and federal business licensing requirements
  • Have a valid tax identification number or equivalent
  • Not be engaged in prohibited business activities (detailed below)

2.2 Business Information

You must provide and maintain accurate:

  • Business name and legal entity structure
  • Business address
  • Ownership and principal contact information
  • Tax identification number
  • Bank account information for payouts
  • Nature and description of business
  • Products or services provided

2.3 Verification and Compliance

All business information is verified by our Processing Partner, Whop, or third-party verification services. Mosco Holdings LLC reserves the right to:

  • Request additional documentation at any time
  • Conduct background checks on business owners
  • Verify business licenses and authorizations
  • Monitor business activities and compliance
  • Suspend accounts pending verification

3. PROHIBITED BUSINESS ACTIVITIES

3.1 Categorically Prohibited

Business Accounts may NOT be used for:

Financial and Investment Services:

  • Offering loans or lending services
  • Operating as a financial institution
  • Providing investment advice or services
  • Operating cryptocurrency exchanges (unless specifically licensed)
  • Operating as an unlicensed money transmitter

Illegal Activities:

  • Selling illegal goods or services
  • Money laundering or financial fraud
  • Operating gambling or lottery services (unless specifically licensed)
  • Drug trafficking or related activities
  • Human trafficking or exploitation
  • Weapons trafficking

Adult and Sexual Content:

  • Adult entertainment or sexual services
  • Pornography or sexually explicit material
  • Sexual paraphernalia (unless specifically licensed)
  • Escort services or prostitution

Deceptive and Harmful Practices:

  • Counterfeit goods
  • Intellectual property infringement
  • Ponzi schemes or multi-level marketing schemes
  • Pyramid schemes
  • Fraudulent services or "get rich quick" schemes
  • Unlicensed insurance services

High-Risk Activities:

  • Unlicensed pharmaceutical or drug sales
  • Medical devices or prescription medications without licensing
  • Unlicensed healthcare services
  • Unregistered securities or offerings

3.2 Restricted Activities

The following activities require pre-approval and additional documentation:

  • Subscription services or recurring billing
  • Collections or debt services
  • Payment processing for other merchants (without authorization)
  • Business services to other business users
  • Multi-channel payment acceptance
  • High-volume or high-value transactions (over $[AMOUNT]/month)
  • International or cross-border payment processing

4. TRANSACTION TERMS FOR BUSINESS ACCOUNTS

4. PAYMENT PROCESSING AND FUND MANAGEMENT

4.1 Whop as Payment Processor

All transactions on Hustlit are processed exclusively by Whop. Whop serves as the intermediate payment processor and handles:

  • Payment acceptance and processing
  • Fraud detection and prevention
  • Transaction settlement
  • Chargeback management
  • KYC and identity verification

4.2 Fund Release and Completion Requirements

Critical Timing Requirement:

No customer funds are awarded to or released to your business until you mark the service or transaction as complete in the Hustlit system.

Transaction States:

  1. Pending State: Transaction accepted, funds held by Hustlit/Whop, awaiting your completion
  2. Complete State: You mark service as delivered/complete in the system
  3. Available State: Funds move from pending to available in your Balance
  4. Withdrawn State: You initiate withdrawal of available funds

Your Obligation: You must mark transactions as complete only when the service has been fully delivered or the product has been transferred to the customer.

4.3 Transactions Handled by Whop

4.2 Settlement Timeline

  • Standard transactions settle within 1-3 business days
  • High-value transactions may require additional verification (3-7 business days)
  • International transactions may require additional time
  • Settlement delays are not Hustlit's responsibility; direct disputes to Whop

4.3 Fees and Commissions

Processing Fees:

  • Hustlit charges a percentage commission on all transactions (current rate: [X]%)
  • Payment processor fees and bank charges apply (see fee schedule)
  • Additional fees apply for chargebacks, disputes, and reversals

Subscription Fees (if applicable):

  • Monthly or annual subscription fees for service access
  • Fees are non-refundable regardless of usage
  • Subscription fees deduct directly from your Balance

Payout Fees:

  • Withdrawal fees apply to all payouts
  • ACH transfers: [X] per transfer
  • Expedited transfers: [X] per transfer
  • International payouts: [X] + percentage fee

5. CHARGEBACKS AND DISPUTES

5.1 Chargeback Process

A chargeback occurs when a customer disputes a transaction through their bank or payment card company. Husth[lit and Whop manage the chargeback process:

  • Customer initiates dispute with their bank
  • Bank issues preliminary chargeback
  • Business User is notified and may submit evidence
  • Whop reviews the evidence
  • Final determination made by the bank/processor

5.2 Chargeback Fees

  • Standard chargeback fee: $[X] per chargeback
  • Multiple chargebacks may result in increased fees or account suspension
  • You are responsible for all chargeback fees regardless of outcome

5.3 Dispute Resolution

Customer Disputes Through Hustlit:

  • Customers may file disputes through our internal dispute system
  • You will be notified and given opportunity to respond
  • Hustlit may investigate and make determinations
  • We reserve the right to deduct disputed amounts from your Balance

Whop Disputes:

  • Disputes involving payment processing go directly to Whop
  • Whop's dispute team will contact you with additional information
  • You must respond to Whop within the specified timeframe (typically 7-10 days)
  • Failure to respond results in automatic loss of dispute

5.4 Balance Deduction for Disputes

Hustlit reserves the right to:

  • Immediately deduct disputed transaction amounts from your Balance
  • Hold funds pending dispute resolution
  • Deduct chargeback fees from your Balance
  • Retain disputed amounts if the customer prevails
  • Pursue collection action for disputed amounts exceeding your Balance

6. REFUNDS AND RETURN POLICIES

6.1 Fund Holding and Transaction Flow

Hustlit Fund Management:

When a customer purchases your product or service through Hustlit:

  1. Payment Processing: The transaction is processed by Whop (our payment processor)
  2. Fund Hold: Hustlit holds all customer funds in a pending state
  3. Service Completion: You must mark the service/product as "complete" in the Hustlit system
  4. Funds Released: Only after you mark the transaction as complete do funds move from pending to available for withdrawal
  5. Withdrawal: You may then initiate withdrawal of available funds

Important: No customer funds are released to your account until you mark the service as complete. This protects both you and the customer.

6.2 Customer Dispute Resolution

Hustlit's Role as Dispute Middleman:

Hustlit acts as the middleman between you and your customers for all disputes filed on our platform. This includes:

  • Refund requests and disputes
  • Service quality complaints
  • Non-delivery or partial delivery claims
  • Product or service issues
  • Any other transaction disputes

Hustlit's Dispute Resolution Authority:

Hustlit has full authority to:

  • Investigate disputes fairly and impartially
  • Request information and evidence from both parties
  • Make determinations on dispute outcomes
  • Award No Refund, Partial Refund, or Full Refund
  • Reverse completed transactions
  • Adjust your Balance based on dispute outcomes

Hustlit Discretionary Decision Making:

Hustlit reserves the right to favor either party (customer or business) for any reason or no reason in our sole discretion. We may:

  • Side with the customer regardless of circumstances
  • Side with you regardless of circumstances
  • Make determinations based on factors not disclosed to either party
  • Change decisions without explanation

You acknowledge that dispute outcomes may not be favorable to your business and accept this as a condition of using the Service.

6.3 Hustlit Refund Policy

Subscription and Service Fees:

Hustlit does NOT provide refunds for:

  • Subscription fees (non-refundable regardless of reason)
  • Service fees or usage charges
  • Payout fees already processed
  • Chargeback fees
  • Account closure or termination

6.4 Customer Refunds and Refund Process

Your Responsibility:

As the Business User, you are responsible for:

  • Providing quality products and services as described
  • Communicating your service terms and completion timeline to customers
  • Marking transactions as complete when service is delivered
  • Responding to customer disputes promptly

Customer-Initiated Refund Process:

If a customer files a dispute requesting a refund:

  1. Customer submits dispute through Hustlit's platform
  2. You are notified and given opportunity to respond
  3. Hustlit reviews all information from both parties
  4. Hustlit makes final determination (No Refund, Partial Refund, or Full Refund)
  5. If refund is awarded, Hustlit initiates the refund to customer's original payment method
  6. Funds are deducted from your Balance or pending funds
  7. You do not process the refund yourself; Hustlit handles it

You Cannot Prevent Refunds:

Even if you disagree with a refund decision, if Hustlit determines a refund is warranted, the refund will be issued from your Balance. You have no right to appeal or reverse Hustlit's refund decision.

6.5 Refund Reversals and Fraud

Hustlit reserves the right to reverse any transaction or dispute decision if:

  • Fraud is detected
  • Abuse of the dispute system is discovered
  • Your account violates our policies
  • Regulatory requirements mandate reversal

7. ACCOUNT SUSPENSION AND TERMINATION

7.1 Reasons for Suspension or Termination

Hustlit may suspend, place on hold, or terminate your Business Account at any time, for any reason or no reason, including but not limited to:

  • Violation of these Terms or Business Use Policy
  • Violation of prohibited business activities
  • Multiple chargebacks or disputes
  • Customer complaints or disputes
  • Suspicious or fraudulent activity
  • Failure to maintain accurate business information
  • Failure to pass compliance or KYC requirements
  • Regulatory requirements or law enforcement requests
  • Non-compliance with payment processor requirements
  • Operational or security risks
  • Business reputation or association concerns

7.2 Immediate Suspension

Hustlit may suspend your account immediately without notice for:

  • Suspected fraud or illegal activity
  • Violation of prohibited activities
  • Security or system risks
  • Regulatory compliance concerns

7.3 Effects of Suspension or Termination

Upon suspension or termination:

  • All transactions are immediately halted
  • New customer payments are not accepted
  • Pending transactions may be cancelled or reversed
  • Your Balance may be frozen or forfeited
  • You lose access to all Service features

8. BALANCE AND FUNDS MANAGEMENT

8.1 Balance Ownership and Control

Your Balance is:

  • Proprietary data owned and controlled by Mosco Holdings LLC
  • Not a bank account or deposit
  • Not insured by the FDIC or similar insurance
  • Subject to deduction at Hustlit's discretion

8.2 Balance Holds and Reserves

Hustlit and Whop may:

  • Hold a percentage of your transactions in reserve (reserve requirement: [X]%)
  • Increase reserves if there is increased risk or dispute activity
  • Release reserves on a rolling basis ([X] days after transaction)
  • Forfeit reserves if your account is terminated

8.3 Deductions from Balance

Hustlit reserves the right to deduct from your Balance:

Automatically:

  • Transaction fees and commissions
  • Processing fees and charges
  • Payout fees
  • Subscription fees
  • Chargeback fees
  • Dispute resolution fees
  • ACH return fees
  • Other processing-related fees

At Hustlit's Discretion:

  • Chargebacks and customer refunds
  • Fraud-related losses
  • Disputed transactions
  • Regulatory fines or penalties
  • Legal costs and settlements
  • Business rule violations or misuse

8.4 Balance Expiration and Forfeiture

  • Any Balance remaining upon account termination may be forfeited
  • Inactive accounts ([X] days) may accrue fees or forfeit Balance
  • Abandoned Balances are subject to escheat laws (unclaimed property)

9. REPORTING AND COMPLIANCE

9.1 Financial Reporting

You understand that:

  • All transactions are reported to tax authorities as required by law
  • 1099-K forms are issued for qualifying transaction volumes
  • You are responsible for reporting all income on your tax returns
  • We provide records upon request for tax purposes

9.2 Know Your Customer (KYC) Compliance

  • All KYC information is handled by Whop
  • You must maintain current and accurate KYC information
  • You must update information within 10 days of any changes
  • Failure to maintain KYC compliance results in suspension

9.3 Record Keeping

You agree to maintain records of:

  • All customer transactions
  • Refunds and reversals
  • Customer disputes and complaints
  • Business operations and activities

You grant Hustlit access to these records for compliance and audit purposes.


10. CUSTOMER DATA AND PRIVACY

10.1 Customer Information Collection

When you use Hustlit to process customer payments:

  • Customer information (name, email, address, etc.) is collected
  • Payment information is processed by Whop and affiliated banks
  • Transaction records are maintained for compliance

10.2 Your Obligations

You must:

  • Clearly disclose to customers that payments are processed through Hustlit
  • Maintain a privacy policy disclosing data handling practices
  • Comply with all applicable privacy and data protection laws
  • Not use customer data for unauthorized purposes
  • Not share customer data without consent
  • Maintain reasonable security for customer information

10.3 Data Access and Deletion

  • Customers have the right to request their data from you (not from Hustlit)
  • You are responsible for responding to customer data requests
  • Hustlit retains transaction records as required by law
  • Deletion requests are subject to regulatory retention requirements

11. REPRESENTATIONS AND WARRANTIES

11.1 Your Representations

By using a Business Account, you represent and warrant:

  • You are legally authorized to enter into this Policy
  • Your business is lawful and authorized
  • You comply with all applicable laws and regulations
  • The information you provided is accurate and complete
  • You will not engage in prohibited activities
  • You have authority to bind your business to these terms
  • Your business will not violate intellectual property rights
  • You will not defraud customers or misrepresent products/services
  • You have obtained all necessary licenses and permits

11.2 Our Disclaimers

WE DO NOT WARRANT:

  • The Service is error-free or uninterrupted
  • The Service will meet your business needs
  • Payment processing will never fail
  • Customers will never dispute transactions
  • Your business will be profitable

12. INDEMNIFICATION

You agree to indemnify and hold harmless Hustlit, Whop, and their respective owners, officers, employees, and agents from any claims, damages, or losses arising from:

  • Your use of the Service
  • Your violation of this Policy
  • Your violation of applicable laws
  • Your business operations or practices
  • Chargebacks or customer disputes
  • Customer complaints or claims
  • Misrepresentation to customers
  • Intellectual property infringement
  • Fraud or illegal activity

13. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, HUSTLIT SHALL NOT BE LIABLE FOR:

  • Loss of profits or revenue
  • Loss of customers or business opportunities
  • Failed transactions or payment processing delays
  • Chargebacks or customer disputes
  • Suspension or termination of your account
  • Loss of Balance or funds
  • Any indirect, consequential, or punitive damages

The maximum liability of Hustlit for any claims is limited to the total fees you paid in the 12 months preceding the claim.


15. CHANGES TO THIS POLICY

Hustlit may update this Policy at any time. Changes to fees and pricing require 15 days' notice. Other changes take effect immediately upon posting. Your continued use of your Business Account constitutes acceptance of updated terms.


16. AGREEMENT TO ALL POLICIES

By using a Business Account and accepting this Business Use Policy, you acknowledge and agree that you have read and agree to be bound by:

  • The Hustlit Terms of Service
  • The Hustlit Privacy Policy
  • The Hustlit Customer Service Policy (for customers using your business)
  • This Business Use Policy

These policies are interconnected and form the complete agreement between you and Hustlit. If there is any conflict between policies, the most restrictive provision shall apply. Your agreement to one policy constitutes your agreement to all policies.

  • Gambling, casinos, and betting
  • Adult entertainment and related services
  • Unlicensed healthcare and pharmaceutical
  • Legal services (with restrictions)
  • Insurance services
  • Escrow and trust services
  • Money transmission and remittance
  • Unlicensed debt collection
  • Weapons and firearms
  • Tobacco and related products
  • Alcohol and beverage (with restrictions)
  • Multi-level marketing and pyramid schemes
  • Other high-risk categories as determined by Whop or Hustlit

Unauthorized operation in these categories will result in immediate account termination.
